Generative AI is taking the world of image editing by storm. Instead of relying on traditional image processing techniques, these models can create entirely new images or modify existing ones in ways that were previously unimaginable.

Consider a tool that can "beautify" your photos. Traditionally, this would involve complex algorithms and manual adjustments. With generative AI, the model can learn from millions of images and automatically enhance your photos, often surpassing human-level results.


The Legal Landscape of AI-Generated Images

As AI-generated images become more sophisticated, legal questions arise. For instance, who owns the copyright to an image created by an AI? The US Copyright Office has clarified that AI-generated works, without human authorship, are not eligible for copyright protection.

However, if a human artist provides creative input, such as selecting prompts or editing the output, copyright protection may be possible. This highlights the importance of understanding the legal implications of AI-generated content. (4)


Watermarking AI-Generated Images: A Complex Challenge

To distinguish AI-generated images from real ones, watermarking techniques are being developed. These watermarks can be embedded within the image data or added as a visible overlay.

While Google's SynthID offers a promising solution, it's not foolproof. Researchers have demonstrated that watermarks can be removed or manipulated, raising concerns about the effectiveness of these methods. (5)


Alternatively, the C2PA standard, used by Meta's "Made with AI" tool, offers a more robust approach. However, it still has limitations, such as the potential for removal through simple screenshots. (6)

As AI continues to advance, addressing the challenges of copyright and watermarking will be crucial to ensuring the ethical and responsible use of this powerful technology.
